UK data protection law requires me to have a valid reason, known as a lawful basis, for using your personal information.
I may use your information in the following ways:
Responding to enquiries, applications and call bookings
I use the identity, contact and application information you provide to respond to you and discuss my services. This is based on my legitimate interest in responding to enquiries or taking steps at your request before entering into a contract.
Providing coaching, programmes, courses and resources
I use your contact, client, coaching, account and transaction information to deliver the services you have requested. This is necessary to fulfil my contract with you.
Processing payments and maintaining financial records
I use relevant contact and transaction information to process payments, issue invoices and maintain accounting records. This is necessary to fulfil my contract with you and meet my legal obligations.
Managing your account and sending service messages
I use your contact, account and transaction information to manage bookings, programmes and services, and to send important information relating to them. This is necessary to fulfil my contract with you and support the effective management of my services.
Sending newsletters, podcast updates and marketing
I may use your name, email address and engagement information to send newsletters, free resources, podcast updates and information about my services. I do this with your consent where required, or on the basis of legitimate interests where permitted by law.
You can unsubscribe from marketing emails at any time.
Improving my website, content and services
I may use technical, usage, engagement and feedback information to understand how people use my website and services and to make improvements. This is based on my legitimate interests. Where required, I will ask for your consent before using non-essential cookies.
Protecting my website and systems
I may use technical, account and correspondence information to prevent fraud, misuse and security incidents. This is based on my legitimate interest in keeping my website, systems and services secure.
Managing complaints, disputes and legal claims
I may use relevant client, contact, transaction and correspondence information to respond to complaints, resolve disputes and protect my legal rights. This is based on my legitimate interests and, where necessary, the establishment, exercise or defence of legal claims.
Meeting legal, tax and regulatory requirements
I may use relevant client, contact and transaction information when necessary to comply with legal, tax, accounting or regulatory obligations.
Publishing testimonials and case studies
I will only publish your testimonial, name, image, audio, video or case study with your permission. The intended use will be explained before anything is published.
Where I rely on legitimate interests, I consider whether using the information is necessary and whether those interests are balanced against your rights and reasonable expectations.
Where I rely on legitimate interests, I consider whether those interests are necessary and balanced against your rights and reasonable expectations.
Health, alcohol-use and other sensitive information
Coaching conversations may include information about alcohol use, health, wellbeing or other sensitive matters. This information may be classed as special category data.
Where special category data is needed to provide coaching, I will normally process it with your explicit consent. You may withdraw that consent at any time by contacting me. Withdrawing consent will not affect information already processed lawfully, but it may mean that I cannot continue to provide some services.
In limited circumstances, sensitive information may also be used where necessary to establish, exercise or defend legal claims, or where another condition under data protection law applies.
Coaching is not medical care, diagnosis, treatment or crisis support. If you need medical advice or urgent support, contact an appropriate qualified professional or emergency service.
Medical and crisis support
PJ Fox Coaching provides coaching and is not a medical, mental health or emergency service.
Before stopping drinking
If you think you may be physically dependent on alcohol, speak to your GP or a local alcohol support service before attempting to stop.
Stopping alcohol suddenly can be dangerous if you experience withdrawal symptoms such as shaking, sweating, anxiety, vomiting or difficulty sleeping.
For confidential medical advice and support:
Speak to your GP.
Visit NHS Alcohol Support to learn more and find local treatment services.
Call Drinkaware on 0300 123 1110. Drinkaware provides free, confidential support for anyone concerned about their own drinking or somebody else’s.
Visit Alcohol Change UK: Get Help Now for further information about alcohol treatment and support across the UK.
Severe Alcohol Withdrawal
Call 999 or go to A&E if you or someone else experiences severe withdrawal symptoms after stopping or reducing alcohol, including:
Severe or visible shaking
Confusion
Hallucinations
Seizures or fits
Do not drive yourself to A&E. Ask someone to take you or call 999 for an ambulance.
Mental health and crisis support
If you or someone else is in immediate danger, call 999 or go to A&E.
If you need urgent mental health support but there is no immediate danger, call NHS 111 and select the mental health option.
You can also contact:
Samaritans: Call 116 123 free, 24 hours a day. Visit Samaritans.
Shout: Text SHOUT to 85258 for free, confidential, 24-hour crisis support. Visit Shout.
These services are based in the UK. If you are outside the UK, contact your local emergency service or healthcare provider.
Coaching call recordings
Coaching calls are not routinely recorded. A call may be recorded if the coachee requests it, for example so they can listen back to the session. The purpose of the recording and how it will be shared and retained will be agreed at the time.
A recording, or an extract from it, will only be used by PJ Fox Coaching for training or within a group coaching programme where the coachee has given separate, explicit permission. Any proposed use will be explained in advance, and reasonable steps will be taken to remove or limit identifying and unnecessarily personal information. A coachee can say no without it affecting their coaching.
Recordings will be stored securely, access will be limited to those who genuinely need it for the agreed purpose, and they will be deleted when no longer required for that purpose. Where a recording includes health, alcohol-use or other special category information, the protections described above under **Health, alcohol-use and other sensitive information** also apply.
Marketing emails
If you sign up for an email series, free resource, newsletter or other marketing, I may use your name and email address to send relevant content and information about my services.
You can unsubscribe at any time by using the link in an email or contacting me. Unsubscribing from marketing will not stop essential messages relating to a service you have purchased, a booking or an active client relationship.
I may keep a minimal suppression record after you unsubscribe so that I can respect your choice and avoid adding you back to a marketing list by mistake.
I do not sell your personal information.
Who I share information with
I only share personal information where necessary and appropriate. Recipients may include:
- Kajabi, which hosts the website, email lists, forms, landing pages, courses and member areas;
- Google Workspace and Google Forms, where used for email, documents, storage and applications;
- Squarespace Scheduling (Acuity), where used to book calls and appointments;
- Payment providers such as Stripe, which process payments securely;
- Video-call and communication providers, such as Zoom or Google Meet, where used to deliver calls or coaching;
- Contractors or professional advisers who support the business, such as accountants, legal advisers or technical support providers;
- Analytics, security and website-service providers, subject to your cookie choices where required;
- Public authorities, regulators, courts or law-enforcement bodies where disclosure is required by law or necessary to protect legal rights; and
- A prospective buyer, seller or adviser if the business or its assets are reorganised, transferred or sold.
Service providers may only use information for the services they provide and must protect it appropriately. Some providers also act as independent data controllers for parts of their services, such as payment processing. Their own privacy notices explain how they handle that information.
International transfers
Some service providers may process information outside the United Kingdom, including in the United States.
Where personal information is transferred internationally, I take reasonable steps to ensure that an appropriate legal safeguard is used. This may include transferring information to a country covered by UK adequacy regulations, using the UK International Data Transfer Agreement or UK Addendum to approved standard contractual clauses, or relying on another safeguard permitted by law.
You can contact me if you would like more information about the safeguards relevant to your information.
Cookies and similar technologies
The website uses cookies and similar technologies. Some are necessary for the website, forms, payments, member areas or security to work. Others may help measure website use, remember choices or support marketing.
Where consent is required, non-essential cookies should not be placed until you make a choice through the website's cookie banner or preference tool. You can change your preferences through that tool and can also control cookies in your browser. Blocking some cookies may affect how parts of the website work.
Because the cookies used can change as website tools are added or updated, the cookie banner or preference tool should contain the current list of cookies, providers, purposes and durations.
How long I keep information
I keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, tax, accounting and reporting requirements.
I may anonymise information so it can no longer identify you. Anonymised information may be kept for research, analysis or business improvement.
How I protect information
I use reasonable technical and organisational measures intended to protect personal information against accidental loss, misuse, unauthorised access, alteration or disclosure. Access is limited to people and service providers who have a genuine need to use it.
No website, email or internet transmission can be guaranteed to be completely secure. Please take care when deciding what information to send electronically.
Your data protection rights
Depending on the circumstances, you may have the right to:
- ask for access to the personal information held about you;
- ask for inaccurate or incomplete information to be corrected;
- ask for information to be deleted;
- ask for the use of your information to be restricted;
- object to processing based on legitimate interests or to direct marketing;
- receive certain information in a portable format;
- withdraw consent at any time where processing is based on consent; and
- ask for human review of a decision made solely by automated means where it has a legal or similarly significant effect.
These rights are not absolute and exemptions may apply. I may need to confirm your identity before dealing with a request. There is normally no fee, and I will usually respond within one month, although the law allows more time for complex requests.
To exercise a right, email [email protected]
Automated decision-making
I do not use personal information to make solely automated decisions that have legal or similarly significant effects on you.
Children
The website, coaching and programmes are intended for adults aged 18 and over. I do not knowingly collect personal information from children through the website. If you believe a child has provided personal information, please contact me so that I can take appropriate action.
Links and third-party websites
The website may link to other websites, platforms or podcast services. I do not control those services and this policy does not cover how they use information. Please read their privacy notices before providing personal information.
Complaints
Please contact me first if you have a concern, so I have an opportunity to resolve it.
You also have the right to complain to the Information Commissioner's Office (ICO), the UK regulator for data protection. Information about raising a concern is available at www.ico.org.uk
If you are outside the UK, you may also have the right to complain to the data protection authority where you live.
Changes to this policy
I may update this policy to reflect changes to the website, services, providers or the law. The latest version will be posted on this page and the date at the top will show when it was last updated.
